Defence Determination
The legislative basis for ESPS payments is Defence (Employer Support Payments) Determination 2005, made under section 58B of the Defence Act 1903. As the Determination is amended from time to time, different versions of the Determination may apply to different periods of Defence service.
- For a claim that relates to Defence service on or after 1 September 2011, the following version of the Determination will apply.
Defence (Employer Support Payments) Determination 2005, prepared 26 October 2011- For a claim that relates to Defence service between 1 September 2005 and 31 August 2011, the following version of the Determination will apply.
Defence (Employer Support Payments) Determination 2005, prepared 15 October 2007 - For a claim that relates to Defence service between 1 September 2005 and 31 August 2011, the following version of the Determination will apply.
On 12 October 2011, Defence (Employer Support Payments) Amendment Determination 2011 (No.1) was signed by the Parliamentary Secretary Defence, Senator Feeney. This Amendment Determination inserted a new provision relating to death on Defence service. The Amendment was taken to have commenced on 1 September 2011.
